Title insurance is simply an insurance policy of property ownership that guarantees a purchaser’s ownership rights.  When purchasing real estate in Mexico we at Baja Smart undoubtedly recommend purchasing title insurance for any real estate acquisition in Mexico. This will protect against losing your title to such instances as:

Gaps in the chain of title.

Liens or financial burdens charged to the previous owner.

Improperly registered legal documents.

Hidden heirs of previous owners.

Non-registered easements.

Survey errors or illegibility of survey.

Contravention of subdivision.

If a claim arises regarding a loss due to the state of title being different than it is set out in the policy, the coverage should provide legal defense and monetary indemnity to pay for a loss up to the face amount of the policy.

There is only a one-time fee for title insurance and it will protect you, your heirs and devisees for as long as property title is held.

The process of opening a title insurance policy requires a detailed title history report to be made by the title company’s attorney(s).  This provides additional security for you in knowing that a third party has done a detailed search for possible title problems.

Fidelity National Financial with an office in San Jose del Cabo is currently the best option for title insurance for foreign owners of Mexican real estate.

Using a U.S. title insurance company gives you the same title coverage you would have in the U.S. or Canada. The policy is enforceable under Mexican law and may provide access to U.S. jurisdiction.
